SPECIAL REPORT: Restaurant Inspections
MONTGOMERY COUNTY -- The average American family eats out about five times a week.  But have you ever stopped to think about how clean the restaurant is?  We decided to check it out for you.  We tagged along with Montgomery County Health Inspector Jeniece Lyons, one of 16 in the county, who check the 4,000 restaurants, caterers and other places serving food, for surprise inspections.

The first stop we made was at Bernstein's Fine Catering in West Carrollton.  Jeniece inspected the kitchen for even the slightest health code violation.  She says the proper preparation, cooking and storage process is all important, and violations are pretty common.

''We get so involved in the day to day operation of our business that sometimes we overlook things'', Steve Bernstein of Bernstein's Fine Catering told us, ''Not critical things, but things that could be critical if left unattended.''

Jeniece gave the catering company an A , but that's not the case on her next couple stops.  She found potential cross contamination at Holly's Home Cooking in West Carrollton, in the form of raw meat being stored next to fresh veggies.

''For the most part they try to do good, but in this business, you'll have your ups and downs'', Alan Pierce, with Public Health Dayton-Montgomery County told us, ''that's when they may need a prod from us to  make sure they shape up.''

Some critical violations were found at 4200 Place in Moraine.  In addition to ready to eat veggies and raw meat being stored next to each other and the cooler being too warm, Jeniece finds that the dishware wasn't being sanitized properly.

''I told them to use bleach-water until they obtained sanitizer for their wash machine.'' Jeniece told us.

But it gets worse.

''They were unable to confirm how long they've been without sanitizer.'' Jeniece says, ''I don't know if someone was monitoring that like they should be.  They said their truck was coming today.''

Neither restaurant let us inside, but Jeniece told us that both restaurants corrected the problems immediately.

But we asked why a restaurant with several violations is allowed to stay open?

''If there are any violations that are observed and they are corrected immediately and it's not detrimental to the public's health then it's kind of forgotten about or less important on our list.'' Jeniece explained, ''To issue orders of cease operations would be to lose water or if your roof was caving in or there was something detrimentally wrong.''

Actually, we found no matter how many violations a restaurant has, there is never a fine!  The only real penalty the health department can hand down is shutting a business down, which rarely happens.

So just what kind of violations did we find?

Well, after going through more than a thousand reports filled with violations from mice droppings in the kitchen to insect eggs in the hall, we only found one restaurant that was shut down immediately after an inspection and that was a place that had raw sewage on the floor!
Once workers cleaned up the sewage, the place was back open for business.  The last time the Montgomery County Health Department revoked a restaurant's license permanently was the 1980s.

So here are some red flags to look for the next time you go out to eat.  Your hot food needs to be hot and cold food needs to be cold.  Obviously if you notice any insects, rodents, or droppings, that's a bad sign.
Make sure to check the restrooms, if those aren't kept up, there might be a likelihood they aren't keeping up the back of the house as well.SPECIAL REPORT: Restaurant Inspections
